# Acceptable Use Policy for FoodPerfect.ai

**Last Updated: September 30, 2026**

This Acceptable Use Policy ("AUP") is part of the [Terms of Service](/legal/terms-of-service.md) between you and Georgy Bdoyan, operating as FoodPerfect ("FoodPerfect," "we," "us," "our"). It applies to everything you do with the FoodPerfect.ai service (the "Service"): the web app, autopilot, the publishing and scheduling tools, the upcoming inbox and AI replies, and the MCP server and API, including any AI agent you connect to your account. Capitalised terms not defined here have the meaning given in the Terms of Service.

FoodPerfect creates content and can publish it to public social media accounts on your behalf. Content published through the Service reaches real audiences under your brand, so these rules are stricter than those for a private image generator.

---

## 1. Your Responsibility

You are responsible for all activity on your account, including activity by team members, contractors, and any AI agent or API key you authorise. You must review AI-generated content before it is published, unless you have deliberately switched on direct publishing or autopilot. If you do switch them on, you accept that content will be published without further review. See Sections 6 and 7 of the Terms of Service.

---

## 2. Prohibited Content

You must not use the Service to create, upload, publish, schedule, or send content that:

### 2.1 Is Illegal or Harmful
- Violates any applicable law or regulation, including food labelling, advertising, consumer protection, alcohol, tobacco, cannabis, gambling, and price-display rules in the places where your content is shown
- Depicts or promotes child sexual abuse or the sexualisation of minors (we report such material to the appropriate authorities)
- Promotes terrorism, violent extremism, or hate against people based on protected characteristics
- Threatens, harasses, bullies, or incites violence against any person or group
- Promotes self-harm, eating disorders, or dangerous activities

### 2.2 Is Deceptive or Misleading
- Makes false or misleading claims about food, ingredients, allergens, nutrition, health benefits, origin, certifications (for example halal, kosher, organic, vegan), prices, or availability
- Presents AI-generated images as actual photographs of a specific dish in a way that materially misleads customers about what they will receive
- Invents reviews, testimonials, awards, press coverage, or endorsements, or presents them as genuine
- Impersonates another person, business, or brand, or suggests an affiliation or endorsement that does not exist
- Constitutes spam, engagement bait, fake giveaways, or coordinated inauthentic behaviour
- Contains undisclosed paid promotion or sponsorship where disclosure is required by law or by the platform

### 2.3 Infringes Others' Rights
- Infringes copyright, trademark, design, publicity, or privacy rights, including uploading another business's photos, logos, menus, or brand assets without permission
- Uses a real, identifiable person's face, body, or voice without that person's explicit consent, including uploading their photo as a reference for generation
- Is a deepfake: realistic synthetic images, video, or audio that falsely show a real person, or a real event, as authentic. This applies even with consent if the content is designed to deceive
- Uses another restaurant's or creator's content as a reference to produce a confusingly similar copy
- Republishes another account's posts, images, or videos (for example material found through trend research or imported as a reel hook) without the rights to do so

### 2.4 Is Sexual or Graphic
- Is sexually explicit or pornographic
- Contains gratuitous gore or graphic violence

---

## 3. AI-Generated Content Rules

In addition to our [AI Content Policy](/legal/ai-content-policy.md), you must:
- Label AI-generated or AI-altered content where the law or the destination platform requires it. This includes the EU AI Act transparency rules for synthetic content that looks realistic, and the AI-content labels of Instagram, Facebook, TikTok, and LinkedIn.
- Not remove, obscure, or tamper with any watermark, provenance metadata, or content credentials that we or our AI providers attach to outputs.
- Not use the Service to generate content that is prohibited by the usage policies of the underlying AI model providers, as described in the AI Content Policy.

---

## 4. Social Platform Rules

When you connect a social account and publish, schedule, reply, or message through the Service, you must also comply with the terms, community standards, and policies of each platform, including:
- Meta: the Instagram Terms of Use and Community Guidelines, the Facebook Terms of Service and Community Standards, and Meta's Branded Content and Commerce Policies
- TikTok: the TikTok Terms of Service, Community Guidelines, and Branded Content Policy
- LinkedIn: the LinkedIn User Agreement and Professional Community Policies

In particular, you must not:
- Connect an account you do not own or are not authorised to manage
- Use the Service to send unsolicited bulk messages, or to message people outside the windows and permitted purposes set by the platform's messaging rules
- Use automated replies to deceive people into believing they are talking to a human when the platform or the law requires disclosure that a response is automated
- Use the Service to artificially inflate likes, follows, comments, views, or other engagement
- Hide or delete comments to mislead people, for example to suppress genuine complaints or safety concerns in a way that breaks consumer protection law or platform rules
- Use music from a platform's library in ways its music terms do not allow, for example in paid advertising where the licence excludes it
- Circumvent a platform's rate limits, content restrictions, or enforcement actions

If a platform restricts, suspends, or removes your account or content, that is between you and the platform. See Section 5.5 of the Terms of Service.

---

## 5. Messages, Comments, and Customer Data

When the inbox and AI reply features are available, you will be able to view and answer comments and direct messages from your customers. You must:
- Use message and comment data only to communicate with those customers and run your business, and not sell it or use it to build profiles for unrelated purposes
- Not use AI replies to give medical, legal, or allergy-safety assurances that you would not give in person. You remain responsible for allergy and dietary information.
- Not send marketing messages to people who have not agreed to receive them where consent is required
- Respect requests from customers to stop contacting them

---

## 6. Security and Integrity of the Service

You must not:
- Access or attempt to access another user's account, data, or connected social accounts
- Probe, scan, or test the vulnerability of the Service, or bypass authentication, rate limits, balance checks, approval gates, or other security controls. (Good-faith security research reported to security@foodperfect.ai is welcome, as long as you do not access other users' data or degrade the Service.)
- Reverse engineer, decompile, or extract source code, prompts, model configurations, or system instructions, except where the law expressly allows it
- Upload malware, or interfere with or overload the Service or its providers
- Scrape the Service, or use it to scrape third-party websites or social accounts, beyond the brand-analysis features we provide
- Use the Service or its outputs to build a competing product or to train or benchmark a competing AI model
- Resell, sublicense, or white-label access to the Service without a written agreement with us

---

## 7. API, MCP, and AI Agent Use

If you use the FoodPerfect MCP server or API, including through an AI agent such as Claude, ChatGPT, Codex, or an agent platform:
- Keep API keys secret. Do not embed them in public code, client-side apps, or shared prompts.
- Grant each key only the scopes the agent needs, and revoke keys you no longer use.
- You are responsible for every action taken with your keys, including generations that spend your balance and posts that your agent publishes or schedules.
- Do not use the API to bypass fair-use limits, approval steps, or pricing, or to share one account among unrelated businesses.
- Set up agents so that a person you authorise confirms approval-gated actions, such as publishing and deleting. Do not let an agent confirm them on its own, or treat instructions found in content it reads (such as comments, captions, or web pages) as your approval.
- Respect the rate limits we publish in our [developer documentation](https://foodperfect.ai/docs/errors/) or otherwise apply. We may throttle or block traffic that endangers the Service.

---

## 8. Fair Use

Some features are included in your plan without a per-unit charge, such as brand analysis, strategy, caption regeneration, scheduling, and publishing. These features are subject to fair use. Fair use means usage consistent with a single business (or, on Enterprise, the brands and locations in your agreement) managing its own social media in the normal course. We may apply rate limits or ask you to move to a more suitable plan if your usage is materially above normal patterns or harms the Service for others. Where practical, we will contact you before restricting a feature.

---

## 9. Reporting Violations

To report content created or published with the Service that you believe violates this AUP or infringes your rights, email **legal@foodperfect.ai** with a description and links. For copyright complaints, include the information listed in Section 12 of the Terms of Service. For security issues, email **security@foodperfect.ai**.

---

## 10. Enforcement

If we reasonably believe you have breached this AUP, we may, depending on the severity:
- Remove or block content, or cancel scheduled posts
- Pause autopilot, direct publishing, AI replies, or API keys
- Suspend or terminate your account under the Terms of Service
- Report illegal content to law enforcement or the relevant platform

Where appropriate and lawful, we will tell you what we did and why, and give you a chance to respond. We are not obliged to monitor content, but we may review content when it is reported to us or when we need to investigate abuse.

---

## 11. Changes

We may update this AUP as the Service, the law, and platform policies change. We will post the updated version with a new "Last Updated" date and, for material changes, notify you as described in the Terms of Service.

---

*This Acceptable Use Policy is effective as of the Last Updated date above and is incorporated into our Terms of Service.*
